Cross-learning workshop on challenges in access to justice within the criminal justice system

Part III and DDJC, an organisation based out of Uttar Pradesh, did an in-depth reading of the legal provisions and discussed the associated legal strategies that can be adopted in cases of caste atrocities, by case workers, lawyers and social activists. The team built a timeline of one sample case. While DDJC informed Part III of the issues faced on the ground, Part III advised DDJC on the steps that can be taken at every stage on behalf of complainants in cases under the SC/ST Act, and discussed specific challenges faced at the pre-trial stage, including at the stage of filing of FIR, when FIR is not registered, when FIR is registered but chargesheet is not filed or is inordinately delayed, when the accused is not arrested, when compensation is not disbursed within the legally stipulated time period or is refused without justification, when the chargesheet is filed by the police but the investigation is inadequate, and other issues faced at various stages of a trial. 

The session also saw a discussion on the possible legal intervention in cases where manual scavengers have been recognised but the relevant legal entitlements have not been provided.
